These Terms of Use govern your access to and use of the birchoryn.com website and the Birchoryn digital platform operated by Birchoryn Technologies Inc. ("Birchoryn", "we", "us" or "our"), located at 250 Yonge Street, Suite 800, Toronto, ON M5B 2L7, Canada. By accessing the platform or submitting an access request, you agree to these terms.

1. Platform Access

Access to the Birchoryn platform is subject to approval through the access-request process described on the Contact page. Birchoryn reserves the right to approve, decline or revoke access at its sole discretion without obligation to provide a reason.

2. Permitted Use

You may use the Birchoryn platform solely for lawful purposes and in accordance with these terms. You agree not to:

  • Use the platform to transmit unlawful, harmful or misleading information.
  • Attempt to gain unauthorised access to any part of the platform or its infrastructure.
  • Reverse-engineer, copy or redistribute any platform feature or content without written permission.
  • Use automated tools to access or scrape the platform except where expressly authorised.

3. Intellectual Property

All content, design, code and platform features made available through birchoryn.com and the Birchoryn digital workspace are the property of Birchoryn Technologies Inc. or its licensors. Nothing in these terms grants you any intellectual property rights beyond the limited licence to use the platform for the purpose described in your access request.

4. Disclaimer of Warranties

The Birchoryn platform is provided on an "as is" and "as available" basis. Birchoryn makes no representations or warranties of any kind, express or implied, regarding the platform's availability, accuracy or fitness for a particular purpose. Use of the platform is at your own risk.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Birchoryn Technologies Inc. shall not be liable for any indirect, incidental, special or consequential damages arising from your use of or inability to use the platform, even if advised of the possibility of such damages.

6. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference. Please review it before submitting an access request.

7. Changes to These Terms

Birchoryn may update these Terms of Use at any time. The date at the top of this page reflects the most recent revision. Continued use of the platform after an update constitutes acceptance of the revised terms.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
